1. Definitions

For the purposes of these Terms, the following definitions apply:

AI Insight
An AI-generated summary or interpretation included in a report to assist users in understanding technical information.

Decision-Ready Report
A report designed to transform technical measurements into clear, actionable information that supports informed decision-making.

Delivery
The successful generation and distribution of a report through one or more supported delivery channels.

Digital Property
Any website, web application, online service, domain, or other digital asset that may be monitored, analyzed, or reported on by WebPerformance Report.

Last Mile
The final stage of transforming technical data into clear, actionable reports delivered to the right people at the right time to support better decisions.

Private Report
A report accessible only to authorized users or recipients.

Public Report
A report intentionally made publicly accessible through a permalink or other supported publishing mechanism.

Recipient
A person invited by the account owner to receive reports through the WebPerformance Report platform.

Report
A collection of measurements, metrics, analyses, visualizations, AI Insights, or other information generated by WebPerformance Report.

Report Engine
The technology platform that orchestrates the collection, processing, analysis, enrichment, generation, and delivery of reports using one or more data sources, measurement services, and artificial intelligence technologies.

Reporting-as-a-Service (RaaS)
The delivery of automated, recurring, and on-demand digital reports through the WebPerformance Report platform as a managed cloud service.


2. Overview

These Terms of Service ("Terms") govern your access to and use of WebPerformance Report ("WPR", "we", "our", or "us").

By creating an account, subscribing to a plan, or using our services, you agree to these Terms.

If you do not agree with these Terms, you should not use WebPerformance Report.

4. Eligibility

You must be at least 18 years old to use WebPerformance Report.

By using the service, you confirm that you are legally able to enter into these Terms.


5. Intended Use

WebPerformance Report is designed primarily for professional use by organizations and individuals responsible for managing, monitoring, or improving digital products and services.

This includes businesses, government agencies, public sector organizations, educational institutions, universities, schools, financial institutions, non-profit organizations, healthcare organizations, digital agencies, consultants, freelancers, developers, technology teams, marketing teams, Digital Property owners, content creators, professional bloggers, and any other organization or individual managing digital properties.

The service is intended to support informed decision-making through automated digital reporting.


6. Accounts

To use certain features, you must create an account.

You may register using email and password or Google Sign-In.

You are responsible for:

  • Keeping your login credentials secure.
  • Providing accurate account information.
  • Maintaining the confidentiality of your account.
  • All activity performed under your account.
  • Ensuring that your use of the service complies with these Terms.

You are responsible for notifying us immediately if you believe your account has been compromised.

We reserve the right to suspend or terminate accounts that violate these Terms or misuse the service.


7. Description of the Service

WebPerformance Report is a Reporting-as-a-Service (RaaS) platform powered by its proprietary Report Engine.

The platform collects, processes, enriches, and delivers automated reports designed to transform technical measurements into Decision-Ready Reports through the Last Mile of digital reporting. Our mission is to deliver the right Report, to the right people, at the right time.

Reports may include, but are not limited to:

  • Web Performance
  • HTTP Security
  • Accessibility
  • Analytics
  • AI-generated Insights
  • Benchmarking
  • Current and future Report Types

Reports may be delivered through:

  • The WebPerformance Report platform
  • Email
  • Public permalinks
  • APIs
  • Other supported delivery channels

WebPerformance Report is designed to assist users in understanding technical information and making better informed decisions.

The service does not replace professional technical, legal, accessibility, cybersecurity, compliance, financial, or business advice.


8. Subscriptions and Billing

WebPerformance Report offers both free and paid subscription plans.

Paid subscriptions may be billed on a monthly or annual basis, depending on the selected plan.

Payments are securely processed by Stripe. WebPerformance Report does not store payment card information on its servers.

By purchasing a subscription, you authorize recurring billing until the subscription is cancelled.

You are responsible for maintaining accurate billing information and ensuring that your selected payment method remains valid.

If a payment cannot be processed, access to paid features may be limited or suspended until payment is successfully completed.

We reserve the right to change subscription plans, pricing, included features, and usage limits. Where changes materially affect paid subscriptions, we will make reasonable efforts to provide advance notice.


9. Cancellations and Refunds

You may cancel your subscription at any time through your account settings or by contacting us.

Cancellation prevents future renewals but does not affect the current subscription period.

Unless otherwise stated, subscription fees are non-refundable.

Refunds are handled in accordance with our Refund Policy.


10. Plans, Deliveries and Usage Limits

Each subscription plan includes a specific set of features and usage limits.

Depending on the selected plan, limits may include:

  • Number of Reports
  • Number of Deliveries
  • Number of Recipients
  • Report Types
  • Delivery Frequency
  • Manual Report Generation
  • AI Features
  • Historical Data
  • API Access
  • Other platform capabilities

Plan limits may change over time as the platform evolves.

Unused Deliveries or other usage allowances do not roll over to future billing periods unless explicitly stated.


11. Report Deliveries

The Report Engine generates Reports according to each user's configuration.

While we strive to deliver reports reliably and on schedule, report generation and delivery depend on multiple factors including infrastructure availability, processing queues, third-party services, and email delivery systems.

As a result, we do not guarantee that reports will always be generated or delivered at an exact date or time.

Temporary delays do not constitute a breach of these Terms.


12. Public Reports and Permalinks

WebPerformance Report may provide publicly accessible report pages through Permalinks.

Public Reports are intended to facilitate sharing, collaboration, benchmarking, research, education, and public transparency.

Users are solely responsible for deciding whether a Report should be publicly accessible.

Private Reports remain accessible only to authorized users and recipients.

WebPerformance Report may provide controls related to search engine indexability, AI crawler access, metadata, and discoverability.

However, once a Public Report has been accessed, indexed, cached, archived, or referenced by third parties, WebPerformance Report cannot guarantee its removal from external systems, search engines, AI assistants, social networks, or other online services.


13. Third-Party Data and Measurement Services

WebPerformance Report generates reports using information obtained from third-party measurement tools, APIs, and cloud services.

These services may include, but are not limited to:

  • Performance measurement services
  • Accessibility testing services
  • Security testing services
  • Analytics platforms
  • Artificial Intelligence providers
  • Email delivery services
  • Cloud infrastructure providers
  • Payment providers

WebPerformance Report does not own or control these third-party services.

Accordingly, we are not responsible for:

  • Service interruptions.
  • API failures.
  • Queue delays.
  • Missing or incomplete data.
  • Changes in methodologies.
  • Changes in scoring systems.
  • Changes in APIs.
  • Temporary or permanent service unavailability.
  • Inaccurate or incomplete results provided by third-party services.

Reports generated by WebPerformance Report are intended to support informed decision-making and should not be considered guarantees of website performance, security, accessibility, legal compliance, search visibility, or business results.


14. AI Features

The Report Engine may include AI Insights as part of Decision-Ready Reports.

These summaries are generated using report-related technical information.

WebPerformance Report does not intentionally include personal information in AI prompts.

AI-generated content is provided for informational purposes only and may contain inaccuracies, omissions, or incomplete interpretations.

Users should not rely exclusively on AI-generated content when making technical, legal, accessibility, cybersecurity, compliance, financial, or business decisions.


15. Google Analytics Reports

Some Reports may integrate with Google Analytics 4.

To provide these Reports, WebPerformance Report may store the Google Analytics Property ID and generated report outputs.

Authentication is performed using secure Service Accounts or other supported authentication mechanisms.

Users are responsible for ensuring they have the necessary permissions to connect and use Google Analytics properties.

WebPerformance Report is not responsible for permission issues, unavailable APIs, missing analytics data, API changes, quota limitations, or other issues originating from Google Analytics or related services.


16. User Responsibilities

You are responsible for ensuring that you have the necessary rights, permissions, and authorizations to use WebPerformance Report.

This includes the right to:

  • Submit Digital Properties.
  • Configure Reports.
  • Connect analytics properties.
  • Invite Recipients.
  • Share Public Reports.
  • Use data submitted to or processed by WebPerformance Report.

You must not use WebPerformance Report to monitor, test, analyze, report on, or distribute information about Digital Properties or data sources without appropriate authorization.


17. Recipients

Paid subscriptions may allow users to invite additional Recipients.

Recipients must confirm their participation through a Double Opt-In process before receiving Reports.

The account owner is responsible for ensuring that invited Recipients are authorized to receive the Reports.

You may not use Recipient features to send spam, unsolicited messages, or unwanted communications.


18. Prohibited Use

You may not use WebPerformance Report to:

  • Violate any law or regulation.
  • Attack, disrupt, overload, or compromise websites, systems, APIs, or networks.
  • Perform malicious scanning, unauthorized testing, or abusive automated activity.
  • Send spam, unsolicited communications, or unwanted report invitations.
  • Abuse third-party APIs, infrastructure, or measurement services.
  • Reverse engineer, copy, scrape, or attempt to compromise the platform.
  • Misrepresent your identity, company, organization, or affiliation.
  • Use the service in a way that harms WebPerformance Report, its users, third-party providers, or other parties.
  • Use the service to build, benchmark, or improve a competing product without prior written permission.

We may suspend or terminate access if we believe the service is being misused.


19. User Content and Ownership

You retain ownership of the Digital Properties, Report configurations, analytics properties, Recipients, and information you submit to WebPerformance Report.

By using the service, you grant WebPerformance Report the right to process this information as necessary to provide, maintain, improve, secure, and develop the service.

We do not sell or rent personal information to third parties.


20. WebPerformance Report Intellectual Property

WebPerformance Report, including its software, design, reports, branding, text, graphics, workflows, templates, Report Engine, AI-generated report structure, platform architecture, and related materials, is owned by WebPerformance Report OÜ or its licensors.

You may not copy, reproduce, modify, distribute, resell, sublicense, or create derivative works from WebPerformance Report without prior written permission.

Nothing in these Terms grants you ownership of WebPerformance Report technology, branding, software, or intellectual property.


21. Service Availability and Maintenance

We aim to keep WebPerformance Report available, reliable, and secure.

However, the service may be interrupted due to maintenance, updates, infrastructure issues, security incidents, emergency fixes, third-party failures, or other reasons.

We may perform planned or emergency maintenance when necessary.

We do not guarantee uninterrupted, timely, secure, or error-free operation of the service.

Temporary service interruptions, delayed Reports, or unavailable third-party integrations do not constitute a breach of these Terms.


22. Changes to the Service

WebPerformance Report is an evolving platform.

We may modify, improve, suspend, or discontinue parts of the service at any time.

We may also add, remove, or change features, Report Types, integrations, pricing, plans, usage limits, AI capabilities, or delivery methods.

Where changes materially affect paid users, we will make reasonable efforts to provide notice.


23. Beta, Experimental, and Early Access Features

From time to time, WebPerformance Report may offer beta, experimental, preview, or early access features.

These features may be incomplete, unstable, limited, or changed without notice.

They may not be available to all users and may be removed or modified at any time.

Beta, experimental, preview, and early access features are provided "as is" and without any warranty.


24. Disclaimer of Warranties

WebPerformance Report is provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, we make no warranties that:

  • The service will be uninterrupted, secure, or error-free.
  • Reports will always be accurate, complete, timely, or up to date.
  • Third-party tools or APIs will always be available.
  • AI-generated content will always be correct, complete, or reliable.
  • Public Reports will or will not be indexed by search engines, AI assistants, or third-party systems.
  • The service will meet every user expectation, business requirement, compliance requirement, or technical requirement.
  • The use of Reports will produce specific technical, financial, legal, operational, SEO, accessibility, security, conversion, or business results.

Reports are provided for informational and decision-support purposes only.


25. Limitation of Liability

To the maximum extent permitted by law, WebPerformance Report OÜ shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.

This includes, but is not limited to:

  • Loss of profits.
  • Loss of revenue.
  • Loss of data.
  • Business interruption.
  • Reputational damage.
  • Search engine visibility changes.
  • Accessibility claims.
  • Security incidents on user websites.
  • Compliance issues.
  • Decisions made based on Reports.
  • Errors or omissions in third-party measurement data.
  • Delays or failures in report delivery.

Our total liability for any claim related to the service shall not exceed the amount paid by you to WebPerformance Report during the three months preceding the event giving rise to the claim.


26. Termination

You may stop using WebPerformance Report at any time.

We may suspend, restrict, or terminate your account if:

  • You violate these Terms.
  • Your payment cannot be processed.
  • You misuse the service.
  • Your activities create risks for WebPerformance Report, our users, third-party providers, or other parties.
  • We are required to do so by applicable law.

Upon termination, access to paid features, Reports, historical data, and other account resources may be limited or removed in accordance with our data retention policies.

Termination does not release either party from obligations incurred prior to termination.


27. Privacy

Your use of WebPerformance Report is also governed by our Privacy Policy.

By using the service, you acknowledge that your personal information may be collected, processed, and stored as described in our Privacy Policy.

The following policies form part of these Terms where applicable:

In the event of any inconsistency between these Terms and a specific policy, the specific policy shall apply to the relevant subject matter.

The latest version will always be published on our website.

Continued use of WebPerformance Report after updated Terms become effective constitutes acceptance of the revised Terms.


30. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Estonia.

Any dispute arising out of or relating to these Terms or the use of WebPerformance Report shall be subject to the exclusive jurisdiction of the competent courts of Estonia, unless mandatory consumer protection laws provide otherwise.


31. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

The invalid provision shall be replaced, where possible, by a valid provision that most closely reflects its original intent.


32. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, Cookie Policy, and any other applicable written agreements, constitute the entire agreement between you and WebPerformance Report regarding the use of the service.

They supersede all prior agreements, communications, proposals, or understandings relating to the service.
